January 10th, 2008 - TWD Industries sued some competitors last year for the following reasons:

  • FORTINET filtering gateways block RA downloads and display an alert presenting RA as a " Spyware" while users could not find a workaround;

  • SYMANTEC antivirus shows a virus alert when RA is installed, destroys RA with automatic scans, and states that RA can be used for malicious purposes, because it lets pirates control remote computers, hence RA is a security threat;

  • SOPHOS antivirus blocks the installation of RA, presents RA as a "Trojan horse" or a "spying worm", and adds that this worm lets intruders to take remotely the control and to access a computer;

  • TREND MICRO antivirus automatically deletes RA and state that RA is a malicious program of the " backdoor" type that lets users to access remotely infected systems, this TWD INDUSTRIES product being, according to the security expert, a malicious program because of its malicious features.

The question was to know why the product of a software publisher is presented as the "public enemy" by other software publishers while this product is not different from competitors like SYMANTEC pcAnywhere, IBM Tivoli or MICROSOFT RemoteDesktop, which also provide remote access, but are not targeted by antivirus vendors as malicious programs.

TWD INDUSTRIES has seen all its demands rejected and has been condemned to pay 10,000 euros (the ruling must be executed even if an appeal is filled -a strange requirement).

According to the Court President all the virus alerts are objective information, motivated and neutral, publishing this information does not constitute denigration and the physical deletion on all customers' machines of a competitor's product stating that it is a virus is perfectly legitimate. What's the point of having laws if the judges do not respect them?

Once more, justice fakes it does not get the point. Once more, an appeal is only the promise to loose even more time and money for the victim which, if it wins finally, will not see its prejudice indemnised, nor will see the denounced anti-competitive practices forbidden.

The goal of the delinquents is reached again: they still can steal TWD's customers by physically destroying its unique product. And their efforts 
in this matter are not slowing down.

It seems that the only innovation our State is willing to defend is the one sold at a premium by foreign groups known for their unfair business practices. At the same time, people wonder why growth is lagging. Rewarding treachery and punishing merit is not the winning strategy.

    GOOGLE condemned for infringement

December 6th, 2007 - Google has been found guilty in appeal. The justice, after 3 years of denial, finally recognized that the evidences collected by the bailiff and the APP were legal and receivable.

One could regret that the judge did not see any unfair competitive practice, nor any willingness to harm TWD's business: he even maintained that "Google has removed the advertisings in year 2005" (despite the fact that the contrary is demonstrated by evidences collected in years 2005, 2006 and 2007).

How the judge did manage to ignore the evidences he said were receivable? Simple: he stated that the generic request "remote software" is the same as "remote anything software", which, up to this judge "is not illicit because it is not an exact representation of the registered brand".

This is false: the law indicates that any unauthorized inclusion of a brand in a sentence or any typo in a brand is an unfair way to use the brand (Art. L. 713-2 to 713-5 of the Intellectual Property Code).

But Google's goal is reached: it is allowed to continue stealing TWD's customers by misusing the brand of its unique product. And Google's efforts in this matter are not slowing down.

Worse:  to further reduce the prejudice caused by Google, the same judge stated that "the increase of TWD's revenues in year 2005 reveals the low impact of Google's infringements".

"Increase"!? "Low impact"!? Either this judge needs its eyes fixed or he should loose his job as a civil servant! A quick look at the figures show that the impact was all but low!

As the allocated 15k do not cover TWD's judicial expenses, wining only harmed the plaintiff by increasing the prejudice. The sole financial loss, if TWD's revenues had been frozen instead of falling down, would have been greater than 15k per month during 3 years, or 540k.


But as TWD's revenues were growing (25% and then 38%) before Google remedied to it, with the same growth rate those revenues have been lowered by more than 1m.


Google has not been punished, nor obliged to repair the prejudice it caused in years 2005, 2006 and 2007 while it knew its harmed TWD, nor even forced to stop publishing its illegal sponsored links.

What a strange way to fuel French innovation.

The "Internet Rights Forum", a government agency where Google is member ("If you have played a leadership role in government and public affairs, have a broad network accross the European political spectrum, we would like to hear from you" and "Google is searching for a senior European government affairs"), did not estimate necessary to publish the decision this time. This lapse of memory is repaired here.

Google is doing so wrong in the USA that new laws are created to protect companies from Google's delinquent behavior.

    TWD Industries is indicted after having sued Google!

GotoMyPC belongs to Citrix, a company where Microsoft invested $185 millions, gave access to its Windows Server source code and gave room for
Citrix engineers in its Redmond office.

February 7, 2006 - Since at least year 2005 Google Inc., the well known "do no evil" search engine, publishes sponsored links to denigrate RA and to present "better alternatives" when one searched for "remoteanything" (see on the left).

Google's policy prohibits adds that harm third-parties. Google states human operators always verify add compliance before publication and used this policy to censure adds. Google used this rule to block adds against... the Church of Scientology.

Google, who benefits from an audiance of 101 visitors per day (August 2006, Nielsen/NetRatings), did not show that care for TWD Industries.

Seing its competitors pay Google to denigrate its products TWD Industries registered the "remote anything" brand and asked the Justice to stop Google.

Google said that the trial had no merit and was only motivated by money because (a) TWD Industries did not contact it to ask for removal and (b) the brand was filled to "ransom" Google. Further, Google said it "immediately removed the litigious links after TWD Industries filled the claim".

The problem with this argument is that Google did not stop as it said. One month after Google pretended the links were removed a bailiff demonstrated the contrary. Since Google continued after a claim, there is little chance that a simple letter would have worked any better.

Then, Google said that TWD's brand was not receivable in this trial because its publication in the official bulletin came just after the claim.

The brand Certificate of Registration states that the brand protection "is effective from the date of registration for a period of 10 years". This registration was done 5 months before the publication -months before the claim- so the brand was perfectly receivable.

Then, Google argued that all bailiff reports (showing that Google did not stop as it pretended) should be discarded because it was not clear if a proxy or a cache was in use when Google's sites were queried.

The problem with this argument is that Google designed its web sites' pages in a way that prevents them from being cached by Internet browsers and proxy servers. Google was unlikely to ignore that point.

Against all expectations, the Court adopted Google's arguments and ruled that TWD Industries had to pay Google's defense costs.

In 2006 and 2007, the APP demonstrated that Google is still selling illegal adds -this time knowing perfectly well that it hurts TWD Industries sales and reputation. Who cares? Certainly not the judge who gave Google a license to kill until the appeal... in year 2009 if TWD is lucky. How useful is a justice that kills the victims?

    After 4 years, the DS welcomes it's first competitor: the Microsoft LCS!

 

 

 

 

 

April 20, 2005 - After 4 years of sales, the Directory Server, publicly released by TWD industries in year 2001 is now facing a competitor, the "Live Communications Server" (LCS), published by Microsoft (see the "Top 10 Benefits of Live Communications Server 2005" on Microsoft's web site).

Mr Bill Gates, at the March 8, 2005 San Francisco Real-Time Collaboration Web Conference, presented the LCS stating "
We chose to invest heavily in real-time communications about three or four years ago, and you can see now the rapid progress we're making" and added "we also need to show the IT organization exactly how they bring these capabilities [VoIP, Chat, Remote Control, File Transfers] in, in a way that can be managed" before concluding: "this is a new kind of product, new for us, new for the industry but we think points the way in terms of the deep integration that people want".

TWD Industries is delighted to see the Redmond giant endorsing the idea that DS architecture is critical to the success of enterprises even if Mr Gates statement "
this is a new kind of product, new for us, new for the industry" will not sound very new to TWD Industries' customers.

It took 4 years (and $384M) for the world software leader to build a pale and unsafe copy of the DS.

The Windows anti-spyware (renamed "Windows Defender") started to treat RA as a spyware in January 2005... just three months before the so mediatised launch of the Microsoft LCS.

Microsoft said that Remote-Anything is absolutely not a spyware but must be treated as such because it is not part of Windows. Of course, Symantec pcAnywhere is not treated as spyware nor are Microsoft remote-access products like System Management Server or Terminal Server, which are yet complying with Microsoft's criteria.

If they can't buy you and fail to do better than you, then they kill you. What a glorious way to stay the leader.

As long as governments will prevent their "independent" Justice Department from enforcing Microsoft indictments, this corporation will continue to break -at no cost- the rules imposed to its competitors, hereby defeating the purpose of the law (which has a value only if equally applied to all).

Democracy's credibility is inversely proportional to the greed of the ones who pretend to serve it.

    Did your bank tell you that SSL is unsafe by-design?

February 15, 2005 - SSL has been designed by Netscape in 1993 -and by 90s' standards it was a welcome addition. Today, three versions later (four with TLS), SSL is widely used in critical applications like online banking, firewalls' remote administration or remote corporate access via VPNs. Application Service Providers  have even based their business model (ASP) on SSL by offering web services on a subscription basis (GotoMyPC, Salesforce, etc.).

Many critical flaws exist in most SSL implementations, mainly because of the wide choice of versions, patches, configuration settings, and ways to usurp certificates or to do totally stealth "subliminal key recovery". Those flaws allow a standard PC to read and modify on the fly the traffic of any 'secured' SSL connection or to impersonate anybody at will.

Due to the heavy investments made in SSL by the IT industry it was necessary to keep SSL compatible with earlier versions (and their flaws) instead of providing a clean and safe implementation. TWD Industries prefers to offer solutions that are safe by default rather than telling users that this is their responsibility to continuously check and tweak their systems in hopeless attempts to be safe because some SSL/TLS, SSH 2 and IPsec flaws are "by-design" and simply cannot be fixed.

There's a huge difference between just pretending to be safe and doing your best to be safe. Adopting technology without trying to understand it clearly leads to join the first category. And a wrong choice may cost you more than you can afford to loose. The fact that a young software company has chosen to tell how bad the current situation is should be far less troubling than the fact that established security leaders have not.

January 5, 2005 - If downsizing is today considered to be the scale of progress in all the industry, one may wonder why this is not also a major trend in the software industry.

The obvious reason is that performance is not the main concern of most software publishers. Instead, they target short development cycles and strategic alliances -both pushing for quick and dirty black boxes integration- at the expense of performance, quality, security
(and common-sense).

Recently this logic reached a pick with this new habit to use 'standard'
(read 'open source') technology to build commercial products.


One may wonder how adequate is the idea to use a sugar cube as an umbrella
-or, given its hectic background in this matter, Microsoft Internet Explorer as the front-end of something sold as a 'security product' (SSL VPNs, remotely administrated firewalls and routers, ASP applications, etc.)

Surprisingly, that's the only choice end-users have and nobody is finding it abnormal. Maybe that's because there is no clear alternative to this mess. Well, not yet.

     January 30, 2003 - TWD Industries changes the free updates and support policy terms

TWD Industries is now applying a different free update and Support policy:

  • new customers purchasing after January 30, 2003 will benefit from one (1) year of free program updates and free technical support. Further program updates and technical support will be charged yearly for 10% of the licenses purchased.

  • customers that have purchased before January 20, 2003 will continue to benefit from the free program updates and support policy as long as they follow what we call an "acceptable behavior" (see below). TWD Industries rewards our early customers for trusting us when we needed it most.

  • in case of abuse, technical support will be suspended on a per case basis at TWD Industries' discretion. The "acceptable behavior" involves sending Support emails to the Support staff only and replying to technical questions so TWD's Support staff can assist customers in solving technical issues. It involves reading the manuals and FAQs if TWD's Support refers to the manuals and FAQs. It involves not discussing personal matters (like sexual orientations, religion or political views) and never using obscene and/or offending vocabulary.
